Read this. It's short. By downloading, installing, or using NeuroRythm, you agree to these terms. If you don't agree, don't use it. We've written this in plain English because legalese is exactly the kind of thing NeuroRythm exists to help you avoid.

Who this agreement is with

These terms are between you and JD Collective Intelligence (ABN 89 734 896 328), operated by James Dale Armstrong, Perth, Western Australia ("we", "us", "NeuroRythm").

What NeuroRythm is

NeuroRythm is a local-first productivity application designed for neurodivergent brains. It runs on your device. Your data stays on your device.

NeuroRythm is sold as a one-time purchase. There is no subscription. You buy it once and it's yours, including all future updates to the version you purchased.

Private beta

If you are using NeuroRythm during the private beta period, you're using software that is still being tested. That means:

Back up your data during beta. NeuroRythm has a built-in backup system. Use it. We are not responsible for data loss during the beta period.

Licence

When you purchase NeuroRythm, we grant you a personal, non-transferable, non-exclusive licence to install and use the software on your own devices.

What we owe you

We will do our best to deliver software that works as described and to fix significant bugs in a reasonable timeframe. We provide support via admin@neurorythm.com.

We do not guarantee that NeuroRythm will be bug-free, available at all times, or suitable for any specific purpose beyond what is described on our website.

Refunds

We offer a 30-day refund from the date of purchase if NeuroRythm does not work as described on our website and we are unable to resolve the issue.

"Doesn't work as described" means a fundamental feature failure — not a design preference, a feature you didn't notice before purchasing, or a bug we are actively working to fix.

Refund requests must be submitted within 30 days of purchase to admin@neurorythm.com with your purchase receipt and a description of the issue.

This refund policy does not limit any rights you have under the Australian Consumer Law.

Your data

You own your data. We don't. See our Privacy Policy for full details on what we collect and why.

Because NeuroRythm is local-first, deleting the application removes your data from your device. We cannot recover it for you.

Limitation of liability

To the maximum extent permitted by Australian law, JD Collective Intelligence's total liability to you for any claim arising from your use of NeuroRythm is limited to the amount you paid for the software.

We are not liable for indirect, incidental, or consequential damages including lost productivity, lost data, or lost profits.

Nothing in these terms excludes any rights you have under the Australian Consumer Law that cannot be excluded by contract.

Changes to these terms

We may update these terms. Significant changes will be communicated via email to registered users at least 14 days before they take effect. Continued use of NeuroRythm after that date constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
